Terms & Conditions (T&C)

Marina Prutsch – VFX Compositing Artist

1. Scope of Application

(1) These Terms & Conditions (T&C) apply to all contracts between
Marina Prutsch, Alstertwiete 1, 20099 Hamburg, Germany
and clients commissioning services in the field of visual effects and post-production.

(2) Deviating terms and conditions of the client shall not apply unless expressly agreed to in writing by the Service Provider.

2. Services Provided

(1) The Service Provider offers professional services in the field of VFX Compositing, including but not limited to:

  • Compositing for film, TV, advertising, and online media

  • Keying, rotoscoping, tracking, matte painting integration

  • Cleanup, set extensions, look development

  • Remote VFX supervision

  • Technical consultation in the post-production workflow

(2) The exact scope of services is defined in the individual offer or project agreement.
(3) Any changes or additions to the agreed scope require written confirmation and may result in additional costs.

3. Conclusion of Contract

(1) A contract becomes valid once the client accepts the Service Provider’s offer in writing or electronically.
(2) Work will commence only after a clear and confirmed commission.
(3) Long-term or recurring projects may be subject to separate framework agreements.

4. Prices and Payment Terms

(1) Fees are based on the agreed daily rate, hourly rate, or project flat rate.
(2) All prices are subject to applicable VAT where required.
(3) Invoices are payable within 14 days from the date of issue without deduction.
(4) In the event of late payment, statutory interest and reminder fees may apply.
(5) Advance payments or partial payments may be agreed upon for larger projects.

5. Deadlines, Delivery & Delays

(1) Deadlines and delivery dates are binding only if confirmed in writing.
(2) Delays caused by missing, faulty, or late delivery of footage, assets, or feedback from the client will extend the delivery schedule accordingly.
(3) The Service Provider is not liable for delays caused by circumstances beyond her control (e.g., server failures, technical issues on the client’s end, late feedback rounds).

6. Client Responsibilities

(1) The client must provide all necessary materials (footage, plates, scripts, LUTs, assets, etc.) in standard professional formats and in a timely manner.
(2) Feedback, notes, and approvals must be delivered within the agreed timeframe.
(3) Errors or delays resulting from insufficient or late delivery of materials fall under the client’s responsibility.

7. Usage Rights & Project Files

(1) The Service Provider retains all copyrights and intellectual property rights to her work, unless otherwise agreed.
(2) Usage rights to the final delivered VFX shots are transferred only after full payment has been received.
(3) Transfer of working files (e.g., compositing project files, scripts, templates) is not included unless explicitly agreed upon.
(4) The Service Provider may use completed and published work as a reference for her portfolio and showreel unless the client explicitly objects.

8. Liability

(1) The Service Provider is liable only for damages caused intentionally or by gross negligence.
(2) Liability for technical failures or data loss caused by the client’s infrastructure is excluded.
(3) The Service Provider is not liable for color deviations, codec issues, or compatibility problems resulting from non-standard or insufficient materials provided by the client.

9. Cancellation & Cancellation Fees

(1) If the client cancels or postpones a confirmed project, the following fees apply:

  • up to 7 days before the project start: no charge

  • 7 to 24 hours before the project start: 50% of the agreed fee

  • less than 24 hours before the project start: 100% of the agreed fee

(2) Work already completed will always be charged in full.
(3) For long-term bookings (multiple days/weeks), a separate cancellation or kill fee may be defined.

10. Data Protection

Personal data is processed solely in accordance with applicable data protection laws. Further details are provided in the Privacy Policy on the Service Provider’s website.

11. Final Provisions

(1) The law of the Federal Republic of Germany applies.
(2) Place of jurisdiction is Hamburg, Germany, where legally permissible.
(3) Should any provision of these T&C be or become invalid, the remaining provisions shall remain unaffected.
